• All orders from High Garden Sàrl may only be made by adults who have reached the age of 18 and enjoy the exercise of civil rights.

• An order is only sent after receiving the payment it is not possible to obtain a waiver.

4. Contract conclusion

• The contract is concluded when High Garden sends you a confirmation.
• If the stock of a product ordered is depleted, High Garden Sàrl reserves the right to cancel or modify the order at any time.
• The buyer cannot, under any circumstances, change or cancel a contract when he has ordered items that have been manufactured and/or customized at his request or when the ordered items are already in the process of being delivered.

• The selling prices of the products are shown in Swiss francs, net amounts, including VAT as well as with possible discounts. 
• Sale prices do not include delivery fees that are available on the order page.

• The order is shipped as soon as possible.
• The delivery time is an indication. High Garden cannot be held liable if the delivery time is extended. The buyer is obliged to accept the delivery even if it is delayed.
• Deliveries with follow-up or recommended, are refunded or returned in case of theft, loss or damage, only if High Garden Sàrl can cooperate with the country’s authorities on the content of the order. Indeed, we will be able to operate the insurance of the post office of your country, only if the content of the order is legal. If this is not the case, we will not be able to ensure a refund or referral.
• High Garden Sàrl does not return or refund orders that have been seized by customs.

7. Risk transfer

• The transfer of risks – which includes the risk of loss as well as the degradation of the commodity – passes to the buyer as soon as the contract is concluded.

8. Return and exchange terms

• Consumable senus products that have been broken cannot be returned or exchanged.
• Defective products can be returned or exchanged for a period of two years. However, if the return is made within 15 days of receiving the order, High Garden Sàrl reserves the right to decide whether the product will be refunded or exchanged by an identical or similar product.

• The cost of return shipments is your responsibility.
• In case of refund High Garden Sàrl has 30 days to transfer the money after receiving the defective goods.
• In case of exchange High Garden Sàrl has 8 weeks to send the order after receiving the defective goods.

9. Payment

• The payment of the goods can be made on the basis of an invoice. High Garden Sàrl may impose a payment method on a buyer or refuse to contract with a buyer.
•  By placing an order with High Garden Sàrl the buyer expressly authorizes us to check his creditworthiness with third-party organizations.
• Regardless of the payment method used, the buyer understands and accepts that his payment can pass through a financial intermediary subject to legal obligations regarding money laundering.
• In the event of an invoice payment, High Garden Sàrl will send the buyer a detailed invoice and a payment slip upon their order.
• In the event of an e-banking transfer, the Buyer must use the contact information mentioned on the invoices or attached to the account statement. 
• High Garden Sàrl accepts payment by Postcard credit cards. The amount will be debited to order.
• If an item is sold out or cancelled, High Garden Sàrl will refund the buyer to its account.
• High Garden is in no way liable for a debit charge.
• In the event of a late payment reminder, an administrative fee will be automatically charged. These costs amount to CHF 7.– (seven francs) in the event of a simple recall, CHF 15.– (fifteen francs) for a second recall and CHF 25.– (twenty-five francs) for a final notice before the opening of a recovery procedure (prosecution).
• In the event of a default, High Garden Sàrl is authorized to transfer its debt against the purchaser to a factoring company, or to mandate a third-party company to recover its debt.

10. Warranty

• In accordance with Swiss law, our goods are guaranteed for two years if it is defective. 
• The warranty does not cover defects resulting from an accident, mishandling, non-compliant use or unauthorized modification or repair, as well as defects that are the result of normal wear and tear over the products over time.
• If it is returned within 15 days to receipt the defective merchandise will be at the choice of High Garden Sàrl or replaced or refunded.

12. Promotional codes 

• If we provide you with a promotional code you must not pass it on to a third party it is reserved for your personal use. In case of abuse High Garden Sàrl may cancel the order or require its return as well as a refund, as well as an increase of 200.- to cover the costs caused by the abuse.
